Annulment

An Annulment May Be Granted If:

  • You or the Defendant have lived in Clark County, Nevada for at least six (6) weeks before you file the Complaint and that party plans to live in Clark County, Nevada, for the foreseeable future after the Complaint is filed.
  • Residency is not required if you and the Defendant were married in Nevada. Annulment of marriages contracted, performed or entered into within the State of Nevada may be obtained by complaint, under oath, to any district court of the State of Nevada for any cause provided by law for annulment of marriage.
  • At least one of the following applies in your case:
    • There is a close enough blood relationship between you and the Defendant that the marriage is prohibited by law.
    • Either you are the Defendant was married to someone else on the day you and the Defendant got married.
    • Either you or the Defendant was younger than 18 at the time of the wedding ceremony and the person who was under 18 years old did not get proper consent before getting married. If this is your situation, the Complaint for Annulment needs to be filed within one (1) year of the underage person becoming 18 years old; and you and the Defendant cannot have lived together since that person turned 18.
    • Either you or the Defendant lacked the understanding of your or the Defendant’s actions to the extent that you or the Defendant was incapable of agreeing to the marriage, (i.e. too intoxicated to make a knowing decision, etc).
    • Either you or the Defendant were insane at the time of the wedding ceremony and that person has not regained his or her sanity or that person has regained his or her sanity and the parties have not lived together since that time.
    • You married the Defendant due to Defendant’s fraud (i.e, Defendant lead you to believe he or she wanted to have children than after the ceremony you found out the he or she didn’t want children; Defendant only married you for money, etc.) If this is your situation, you cannot have lived with the Defendant since you learned of the fraud. Fraud must be proved in a court hearing.

  If you spouse disagrees with the annulment and files an answer to your complaint with the court, both parties may need to hire Attorneys.
