Guardianship Without a Hearing - Minor Child
Requirements:
- The proposed ward is younger than 18 years old.
- Two people will be co-guardians of the proposed ward. And at least one of those people is a resident of Nevada for at least 6 weeks prior to the filing and both are competent.
- Children 14 years or older must sign consents.
- One of these apply:
- Both natural parents will sign consents.
- One is deceased and the other natural parent will sign.
- One natural parents rights have been terminated by Court order and the other will sign.
- The child’s natural mother will sign and the identity of the father is unknown This must be proved with a birth certificate.
Guardianship With A Hearing - Minor Child
A hearing is needed for the Appointment of Guardianship if one or both of the natural parents will not sign a consent form.
Requirements:
- The proposed ward is younger than 18 years old.
- Two people will be co-guardians of the proposed ward, and at least one of those people is a resident of Nevada for at least 6 weeks prior to the filing and both are competent.
- The proposed ward and the petitioners must attend a court hearing.
Guardianship - Adult
Guardianship may be needed if someone cannot take care of him/herself and /or his or her property.
Requirements:
- The proposed ward is 18 years or older.
- The person petitioning for guardianship is a resident of Nevada for at least 6 weeks prior to the filing and is competent.
- The proposed ward lives in Nevada.

Residency Information: The State of Nevada has a residency requirement for filing a Nevada guardianship, for both the Guardian and the Ward. To prove your residency, someone else residing in Nevada for at least 6 months must sign an affidavit swearing that you have resided here for at least 6 consecutive weeks. If your residency has been short-term or is otherwise questionable, the courts may require additional proof of residency. We do not encourage, assist or participate in frauds upon the court related to questionable residency.
