Declaration of Homestead
- When you record a Declaration of Homestead, Nevada law protects the equity in the home up to $125,000.
- This protection precludes seizures or forced sale of your residency by general creditor claims.
- The homestead law does not protect you against debts secured by a mortgage or deed of trust, payment of taxes, IRS lien, Mechanics lien, child support of alimony payments.
- There are basically three types of property that can be protected:
- Land with a dwelling house and its fixtures and buildings.
- A mobile home.
- A condominium.
- It is wise to file a Homestead Declaration upon the purchase of your home and taking title to it, or as soon as possible thereafter.
