Will
If you chose to have a will prepared, this may be done without a Trust. Please be aware of the following when considering having a will prepared:
- Federal estate tax considerations often cause people to make Will provisions which they may not otherwise make. If you have a taxable estate having a market value in excess of $600,000 at the time of your death, your estate may be subject to estate tax at your death.
- If you own property jointly with another person as "joint tenants with right of survivorship", then your interest in that property will pass to the suvivor upon your death. It will not pass according to the terms of your Will.
- Your estate could be subject to inheritance tax even if it isn't subject to federal taxation.
- With a Will your estate will probably have to go through probate which may be costly to your estate.
